当事人从2015年5月至2022年5月期间，通过其法定代表人注册的淘宝网店“重庆康明斯CCEC”销售假冒侵犯“康明斯”注册商标专用权的发动机皮带、水泵皮带、风扇皮带、修理包、油封，经办案民警梳理、当事人确认，随案移交已销售金额共96972.52元，该款项用于冲抵罚款，由于当事人没有记账，无法查实购货价格，因此，违法所得无法计算。<p> 2022年7月5日，权利人康明斯（中国）投资有限公司对公安机构扣押的“康明斯皮带”等侵权商品进行鉴定，并向重庆市公安局渝中区分局出具了《鉴定函》及《价格证明》，公安机关于2022年6月28日在当事人库房内查获的、经权利人确认为侵权商品金额共78243.27元。以已销售金额及未销售侵权商品的货值金额计算违法经营额，当事人的违法经营额为175215.79元。</p>
